Abstract: Warum agiert der moderne Kriminelle, vom Mitglied der Baby-Gang bis zum Einbrecher, mit einer in vergangenen Epochen unbekannten Dreistigkeit und Arroganz? Dieses Kapitel analysiert die Psychologie der Straflosigkeit durch die Linse der Evolutionsbiologie und der Neurowissenschaften. Unsere DNA hat uns vorprogrammiert, offen feindseliges Verhalten gegenüber der Gruppe zu vermeiden, indem sie uns die urzeitliche Angst vor der sofortigen physischen Reaktion der anderen Knoten einflößt. Aber der moderne Staat hat durch die Auferlegung der immanenten Domäne der Menschenrechte diese instinktive Reaktion gesetzlich „abgeschaltet“. So entsteht die „Translation der Bedrohung“: Der Kriminelle fürchtet nicht mehr die Menge, sondern nur noch die langsame bürokratische Maschinerie des Staates. Diese Verschiebung erzeugt ein neurobiologisches Desaster. Aufgrund des Mechanismus des Delay Discounting (die zeitliche Abwertung) nimmt das Gehirn des Raubtiers die zukünftige Verurteilung nicht als biologische Gefahr wahr, sondern verarbeitet sie kalt (über System 2) als kalkuliertes Geschäftsrisiko. Abstract: Why does the modern criminal, from the youth gang member to the serial burglar, act with a brazenness and arrogance unknown in past eras? This chapter analyzes the psychology of impunity through the lens of evolutionary biology and neuroscience. Our DNA has pre-wired us to avoid openly hostile behaviors toward the group, instilling in us the primordial fear of the immediate physical reaction of other nodes. But the modern State, through the imposition of the Immanent Domain of human rights, has legally “turned off” this instinctive reaction. This generates the “Translation of the Threat”: the criminal no longer fears the crowd, but only the slow bureaucratic machinery of the State. This shift produces a neurobiological disaster. Due to the mechanism of Delay Discounting, the predator’s brain does not perceive future conviction as a biological danger, but coldly processes it (via System 2) as a calculated business risk. At the same time, the criminal develops a fierce contempt for the victim: forced by law to turn off their System 1 (instinct of self-preservation) to adapt to an artificial ecosystem, the prey is decoded by the predator’s animal instinct as a “sub-human”, triggering the ruthless neurochemistry of dominance.
