Chapter 17. The Constitutional Algorithm and the Zeroing of Topological Value
Abstract: Original human communities were born, organized, and cured spontaneously by following the directives engraved in our evolutionary DNA. Modernity interrupted this organic flow by introducing an artificial “source code”: the Constitution. This essay analyzes the original sin of Western democracies: having written the constitutional algorithm based on the ideology of abstract and inalienable human rights. Through the “murder paradox,” it is demonstrated that the law protects the network, not life in a vacuum. To explain today’s short-circuit, the Mechanics of Community introduces the “Topological Value” (Vt): the specific weight of a node based on the direction of its actions. Embracing the evolutionary ethics of Haidt and de Waal, it is demonstrated that human morality coincides exactly with this value, which must not be confused with persistent Social Rank. The Constitution, by subordinating Topological Value to the untouchability of individual rights, generates a lethal aberration: it places the citizen defending their home and the thief on the same legal plane, sanctioning the equivalence between the white blood cell and the pathogen, and condemning the organism to self-destruction.
