Chapter 19. The “Perfect Constitutions” and Systemic Collapse
Abstract: Western intelligentsia regularly celebrates the Constitutions of the Global South (such as those of post-apartheid South Africa, Ecuador, or Bolivia) as the most beautiful and advanced legal texts of humanity. This chapter uses the Mechanics of Community to transform these paper utopias into the ultimate clinical test against the ideology of Positive Rights. Supported by the fierce economic and legal critiques of thinkers like Friedrich von Hayek, Stephen Holmes, Cass Sunstein, and Roberto Gargarella, the essay demonstrates how the insertion of infinite unconditional socio-economic rights, in the absence of a real Thermodynamic Surplus, produces not emancipation, but the bankruptcy of the ecosystem. By analyzing the South African case and the South American “extractive illusion,” the text reveals what happens when legal illusion clashes with the end of material energy. The Predictive Error (Δp) of the population explodes. The current chaos in these Nations — characterized by fierce xenophobic pogroms in South Africa or the surrender of the State to narcos in Ecuador — is the unavoidable mechanical discharge of a community that was promised a utopia, condemning it to disintegration.
