Dieses Kapitel nutzt die Mechanik der Gemeinschaft, um diese papiernen Utopien in den ultimativen klinischen Test gegen die Ideologie der positiven Rechte zu verwandeln. Gestützt auf die scharfen ökonomischen und juristischen Kritiken von Denkern wie Friedrich von Hayek, Stephen Holmes, Cass Sunstein und Roberto Gargarella zeigt der Essay auf, wie die Verankerung unendlicher, bedingungsloser sozioökonomischer Rechte in Ermangelung eines echten Thermodynamischen Überschusses keine Emanzipation, sondern den Bankrott des Ökosystems hervorbringt. Questo capitolo utilizza la Meccanica della Comunità per trasformare queste utopie di carta nel test clinico definitivo contro l’ideologia dei Diritti Positivi. Supportato dalle feroci critiche economiche e giuridiche di pensatori come Friedrich von Hayek, Stephen Holmes, Cass Sunstein e Roberto Gargarella, il saggio dimostra come l’inserimento di infiniti diritti socio-economici incondizionati, in assenza di un reale Surplus Termodinamico, non produca emancipazione, ma la bancarotta dell’ecosistema. Este capítulo utiliza la Mecánica de la Comunidad para transformar estas utopías de papel en la prueba clínica definitiva contra la ideología de los Derechos Positivos. Apoyado por las feroces críticas económicas y jurídicas de pensadores como Friedrich von Hayek, Stephen Holmes, Cass Sunstein y Roberto Gargarella, el ensayo demuestra cómo la inserción de infinitos derechos socioeconómicos incondicionales, en ausencia de un Excedente Termodinámico real, no produce emancipación, sino la bancarrota del ecosistema. Abstract: Western intelligentsia regularly celebrates the Constitutions of the Global South (such as those of post-apartheid South Africa, Ecuador, or Bolivia) as the most beautiful and advanced legal texts of humanity. This chapter uses the Mechanics of Community to transform these paper utopias into the ultimate clinical test against the ideology of Positive Rights. Supported by the fierce economic and legal critiques of thinkers like Friedrich von Hayek, Stephen Holmes, Cass Sunstein, and Roberto Gargarella, the essay demonstrates how the insertion of infinite unconditional socio-economic rights, in the absence of a real Thermodynamic Surplus, produces not emancipation, but the bankruptcy of the ecosystem. By analyzing the South African case and the South American “extractive illusion,” the text reveals what happens when legal illusion clashes with the end of material energy. The Predictive Error (Δp) of the population explodes. The current chaos in these Nations — characterized by fierce xenophobic pogroms in South Africa or the surrender of the State to narcos in Ecuador — is the unavoidable mechanical discharge of a community that was promised a utopia, condemning it to disintegration.
