1. The Topology of Action: The Synergy of Predictive Engines
To understand the mental short-circuit that paralyzes a contemporary citizen or a police officer in the face of an attack, we cannot simply study penal codes. We must take a step back, look inside our heads, and take the reader by the hand, dissecting in simple terms how the architecture of human action is constructed.
When an individual moves and acts in the world, their brain (the predictive engine) processes reality by traveling on two natural operational tracks. These two domains are not a cultural invention, but the habitat forged by our DNA over millions of years of evolution for a single purpose: to keep us from dying.
A. The Environmental Domain: It is the basic physical interface. Man against matter, gravity, weather, the river to cross, distance. In this domain, the individual struggles to master nature. B. The Social Domain: It is the relational interface. It activates as soon as another human being appears. The individual is no longer isolated: they become part of a tribe (or a micro-community), assume a Role, and constantly balance dangers and cooperation within the group.
In both of these domains, biology imposes a relentless baseline classification upon us: every element we interact with must be scanned to determine whether it is a Threat (to flee from or destroy) or a Resource (to use, thank, or protect).
To operate successfully in these two domains and measure Threats and Resources, our biology has equipped us with two perfect cognitive tools. As explained by the Nobel Laureate in Economics and psychologist Daniel Kahneman (2011), we possess two mental “softwares”:
- System 2 (The rational mind): It is slow, reflective, analytical, and calculating. It consumes a lot of energy and is indispensable for cold planning.
- System 1 (Instinct): It is our “autopilot.” It is fast, reactive, emotional, effortless, and saves our lives in emergencies, triggering the fight-or-flight response.
It is fundamental to understand that, in nature, both of these systems operate in total and physiological synergy within the two natural domains. Imagine having to cross the rapids of a tumultuous river (Environmental Domain) together with other people (Social Domain). Before entering the water, we sit on the bank and plan the action: we study the currents, build a solid raft, and assign tasks to the group. In this phase of cold planning, we are activating System 2. But as soon as we enter the water and the raft is swept away by the rapids, slow planning is no longer useful. System 1 activates instantly. The action becomes visceral and millisecond-fast. System 1 makes us paddle desperately to avoid the rocks (Threat) and pushes us to immediately restrain a panicking companion who risks capsizing us all. Our genome designed us to transition fluidly from slow programming to life-saving instinctive action.
2. Micro-Communities and the Geometry of the Role
To ground this biological dynamic in daily life, let us apply it to the ecosystem of a modern city. Human communities are multiple and stratified.
Imagine walking into a coffee shop to get an espresso. In that moment, we become part of a micro-community. Our brain activates System 2 to peacefully frame the situation, causing us to assume a precise Role: we are simultaneously “citizens” (who respect State laws, like not stealing or killing) and “customers” of the coffee shop. As customers, we instinctively adapt to the unwritten rules of that specific micro-community: if there is a line at the register, we join it and respect it; if the barista serves us, we thank them. It is a situation of thermodynamic calm where all nodes operate peacefully within their perimeter.
But suppose that, suddenly, the door bursts open and a man armed with a gun rushes into the shop, screaming to hand over the cash. In that precise millisecond, the structure of the micro-community is upended. The individual who just entered, besides theoretically being a citizen, assumes a very specific Role imposed by his material action: he is a Robber.
The predictive engine of the customers and the shop manager registers the vital emergency. The robber’s action (the threat of death to extract resources) is pre-programmed by his DNA to obtain a parasitic advantage. Similarly, the reaction of those in the shop is pre-wired by our source code: faced with the Role of the “Robber,” the brains of those present turn off the reflective System 2 and instantly turn on System 1. Adrenaline surges, the mind frames the intruder as an absolute lethal Threat, and prepares the body to react in only two ways: flee or attack to survive. It is nature taking its course, the raw and perfect engineering of survival in the Social Domain.
3. The Constitutional Hallucination: The Immanent Domain and the Double Role
If human beings functioned solely on the laws of biology, the robber would be confronted by the group as a pathogen and neutralized. But here the engineering drama of Western civilization comes into play.
Above these two natural tracks, the modern State has forcibly inserted a third, entirely artificial level: the Immanent Domain of Human Rights. Imagine this domain as a gigantic invisible cage that drops from above and envelops every single citizen. Born post-war with the noble but illusory intent of eradicating violence from the world by decree, this cage establishes an untouchable philosophical dogma: every human being, regardless of the atrocities they are committing, possesses an immanent value and absolute sacred rights.
The lethal anomaly of this domain is not having introduced the protection of the person, but having generated an unsustainable Splitting of the Role within the ecosystem. In the micro-community of the coffee shop under attack, the Immanent Domain overlaps with biology. Modern law establishes that the person holding the gun is not just a “Robber” (a Threat to be destroyed), but is simultaneously a “Bearer of Inalienable Rights” (an Absolute Value to be protected).
No human being is genetically pre-programmed to interact in such a domain. The human mind is not built to process an entity that is simultaneously a lethal Threat to one’s own life and a Supreme Good to be safeguarded, despite not being a Resource in any way. This is where the law commits its neurological havoc: the Immanent Domain forbids the victim from using instinct. It forces us to forcibly turn off System 1 (the life-saving reaction) right in the middle of an emergency, compelling us to activate the slow System 2 to philosophize about the rights of the person threatening us.
As demonstrated by the renowned neuroscientist Antonio Damasio (1994), the pretense of making rapid, vital decisions relying exclusively on pure reason, detached from instinctual inputs, inevitably leads to decision-making paralysis. The brain shuts down due to the short-circuit.
4. The Tilt of Human RAM: Cognitive Load Asymmetry
This topological schizophrenia generates a fatal bio-mechanical distortion: Cognitive Load Asymmetry. Imagine our mind as a computer’s RAM. Under severe stress, available RAM is very scarce. The current state organization gives all the RAM to the predator, sending the prey’s RAM into a tilt.
Let us analyze three classic scenarios to see how the pathogen skillfully uses the Immanent Domain to their advantage:
A. The jeweler and the armed thugs Let us return to the example of an armed robbery in a jewelry store. How does the mind of the robbers work? They used their slow calculator (System 2) only once, in cold blood, comfortably sitting at home to plan the action. Knowing the law, they calculated the risks: they decide to use unloaded guns or to hold a knife to a throat merely to frighten, knowing that if they do not kill, they will receive negligible sentences. Having done this programming, the moment they smash the door, they turn off reflection, immerse themselves in the Environmental Domain, and act guided by pure animal instinct (System 1), free and fast in the chaos.
And the jeweler? The criminals know perfectly well that the victim will not go so far as to kill them for fear of the law, and they also know that the state system would compensate them if they were injured while fleeing. For the jeweler, the State imposes the nightmare of keeping his slow System 2 constantly turned on at 100% during the robbery. While he has a gun in his face, his System 1 injects him with adrenaline, ordering him to take down the Threat. But his forced System 2 blocks him, reminding him of the robber’s “Double Role” and warning him that if his reaction is not proportionate to the millimeter, he will end up in prison for murder. The jeweler’s computer goes into tilt due to the overload of data to be analyzed in fractions of a second. The thugs decide the level and pace of the clash; the jeweler can only hope to adapt, remaining frozen.
B. The police officer and the urban harasser An altered subject decides to stand in the street and punch passing cars. He decides the level of the clash, and is guided by pure instinct (System 1). He can rest assured that his violence will end there and that no one will lynch him on the spot. The intervening police officer, instead, must fight against their own biology. Military psychologist Dave Grossman (2004) has empirically demonstrated that when the heart rate spikes in an emergency, the prefrontal cortex (the seat of System 2) naturally deactivates to make room for reflexes. But the State forbids it. The police officer must keep System 2 active at all times to calculate procedural codes, remembering the untouchable immanence of the person devastating the street. Split between the duty to stop the criminal and the obligation to protect his inviolable rights, the officer hesitates. The pathogen wins the friction by paralyzing the opponent.
C. The citizen and the roadblock Protesters lie down in the street blocking traffic. Here too, the disruptors’ System 2 was activated beforehand: they calculated at a desk that, by lying down defenseless, the guaranteeist system will not allow the police or passersby to harm a hair on their heads. The normal citizen stuck in the car experiences the tear. His instinct (System 1) commands him to get out and physically remove the bodies to free the common Resource. But his System 2 (the fear of criminal charges for harming the activist’s immanent value) acts as a handbrake. The citizen white-blood-cell shuts down to avoid ending up in court.
Conclusion: The Hacking of the Nervous System
Modern Western Constitutions were written with the intent of elevating humanity, demanding the use of rationality in every situation. But neurobiology shows us that the forced insertion of the Immanent Domain has simply “hacked” the nervous system of honest citizens. By assigning the predator the double role of “Threat” and “Absolute Good to be protected,” the State has generated a lethal system crash.
By forcing the prey to turn off their survival instinct (System 1) and turn on laborious legal reasoning (System 2) right at the moment when the pathogen is using animal instinct to attack the network, the West has not civilized society. It has handed the tactical, psychological, and initiative advantage solely to those who want to destroy the social pact.
