Abstract: Unter Anwendung der „Theorie der Drei Domänen“ auf die rechtliche Architektur des Staates deckt dieses Kapitel den Kurzschluss auf, der die Wirksamkeit des westlichen Justizsystems zerstört hat. Historisch gesehen entstanden Gesetze, um in der Sozialen Domäne zu operieren: Ihr ausschließlicher Zweck war es, das Ökosystem zu schützen, das Pathogen zu sanktionieren und das thermodynamische Feuer der Gemeinschaft zu löschen. Heute hingegen wurde das Rechtssystem gewaltsam umgeschrieben, um in der Immanenten Domäne der abstrakten Rechte zu operieren. Durch die Analyse der historischen Kollision zwischen alten, auf die Nation ausgerichteten Kodizes und neuen, auf das Individuum ausgerichteten Verfassungen legt der Text zwei emblematische klinische Fälle dar: das Grenzmanagement und die illegale Hausbesetzung. So wird die Figur des zeitgenössischen Richters analysiert, der zum Opfer einer tiefgreifenden funktionalen Schizophrenie geworden ist: Dazu berufen, die Gemeinschaft zu verteidigen, sieht er sich mit Urteilen konfrontiert, die zu „Makulatur“ (Altpapier) werden, da die Verfahrenskodizes den Aggressor schützen. Die Justiz, entwurzelt aus ihrer organischen Natur, verwandelt sich von einem Instrument der Heilung in den bürokratischen Arm der Entropie.

Capitolo 28. La Giustizia del Discontinuum e il Cortocircuito dei Diritti Immanenti

Abstract: Applicando la “Teoria dei Tre Domini” all’architettura legale dello Stato, questo capitolo svela il cortocircuito che ha distrutto l’efficacia del sistema giudiziario occidentale. Storicamente, le leggi nascevano per operare nel Dominio Sociale: il loro scopo esclusivo era proteggere l’ecosistema, sanzionare il patogeno e spegnere l’incendio termodinamico della comunità. Oggi, invece, il sistema legale è stato forzosamente riscritto per operare nel Dominio Immanente dei diritti astratti. Attraverso l’analisi della collisione storica tra vecchi codici orientati alla Nazione e nuove Costituzioni orientate all’individuo (fenomeno diagnosticato da studiosi come M. Villey e R. Hirschl), il testo espone due casi clinici emblematici: la gestione dei confini e l’occupazione abusiva. Si analizza così la figura del giudice contemporaneo, vittima di una profonda schizofrenia funzionale: chiamato a difendere la comunità, si ritrova con sentenze che diventano “carta straccia”, poiché i codici procedurali tutelano l’aggressore. La Giustizia, sradicata dalla sua natura organica, si trasforma da strumento di guarigione a braccio burocratico dell’entropia.

Abstract: Aplicando la “Teoría de los Tres Dominios” a la arquitectura legal del Estado, este capítulo revela el cortocircuito que ha destruido la eficacia del sistema judicial occidental. Históricamente, las leyes nacían para operar en el Dominio Social: su objetivo exclusivo era proteger el ecosistema, sancionar al patógeno y apagar el incendio termodinámico de la comunidad. Hoy, en cambio, el sistema legal ha sido reescrito a la fuerza para operar en el Dominio Inmanente de los derechos abstractos. A través del análisis de la colisión histórica entre viejos códigos orientados a la Nación y nuevas Constituciones orientadas al individuo (fenómeno diagnosticado por estudiosos como M. Villey y R. Hirschl), el texto expone dos casos clínicos emblemáticos: la gestión de las fronteras y la ocupación abusiva (okupación). Se analiza así la figura del juez contemporáneo, víctima de una profunda esquizofrenia funcional: llamado a defender a la comunidad, se encuentra con sentencias que se convierten en “papel mojado”, ya que los códigos procesales tutelan al agresor. La Justicia, erradicada de su naturaleza orgánica, se transforma de instrumento de curación a brazo burocrático de la entropía

Chapter 28. The Justice of the Discontinuum and the Short-Circuit of Immanent Rights

Abstract: Applying the “Theory of the Three Domains” to the legal architecture of the State, this chapter unveils the short-circuit that has destroyed the efficacy of the Western judicial system. Historically, laws were born to operate in the Social Domain: their exclusive purpose was to protect the ecosystem, sanction the pathogen, and extinguish the thermodynamic fire of the community. Today, however, the legal system has been forcibly rewritten to operate in the Immanent Domain of abstract rights. Through the analysis of the historical collision between old codes oriented towards the Nation and new Constitutions oriented towards the individual (a phenomenon diagnosed by scholars such as M. Villey and R. Hirschl), the text exposes two emblematic clinical cases: border management and abusive squatting. It thus analyzes the figure of the contemporary judge, victim of a profound functional schizophrenia: called upon to defend the community, he finds his rulings turned into “scrap paper” because procedural codes protect the aggressor. Justice, uprooted from its organic nature, transforms from an instrument of healing into the bureaucratic arm of entropy.

Abstract: Im vorherigen Kapitel haben wir die Autopoiesis der „Leeren Maschine“ diagnostiziert: Die untere und mittlere Bürokratie verteidigt den Kriminellen, um ihr eigenes wirtschaftliches Überleben zu sichern. Wenn wir den Blick jedoch auf die absolute Spitze der Pyramide richten, offenbart sich eine weitaus dunklere Geometrie der Herrschaft. Dieses Kapitel demonstriert, wie die Verankerung positiver „Menschenrechte“ in den Verfassungen das Volk mathematisch vom Souverän zum Diener degradiert hat, indem die absolute Macht einer unantastbaren Oligarchie übergeben wurde: der Juristokratie. Um diese Hegemonie aufrechtzuerhalten, ohne direkte Aufstände zu riskieren, haben die Eliten die lineare Unterdrückung durch eine „Tyrannei durch Stellvertreter“ ersetzt. Durch die Metapher des Ameisenhaufens und alltägliche klinische Fälle (von blockierten Abschiebungen bis hin zu illegalen Hausbesetzungen) offenbart der Essay, wie das Makrosystem das einzelne Pathogen (den Kriminellen, den Vandalen) als eine regelrechte biologische Waffe einsetzt. Indem die Oligarchie die sozialen Antikörper durch Gerichtsurteile zerschlägt, erreicht sie ihr doppeltes thermodynamisches Motiv: die Zerstörung der Kohäsion des Horizontalen Vektors (Divide et Impera) und die Erzeugung einer absoluten Abhängigkeit des terrorisierten Bürgers von der Leeren Maschine.

Capitolo 25. L’Asservimento Costituzionale e la Tirannia per Interposta Persona

Abstract: Nel capitolo precedente abbiamo diagnosticato l’Autopoiesi della “Macchina Vuota”: la bassa e media burocrazia difende il criminale per garantirsi la sopravvivenza economica. Tuttavia, se alziamo lo sguardo verso il vertice assoluto della piramide, emerge una geometria del dominio ben più oscura. Questo capitolo dimostra come l’inserimento dei “Diritti Umani” positivi nelle Costituzioni abbia matematicamente trasformato il popolo da sovrano a servo, consegnando il Potere assoluto a un’oligarchia intoccabile: la Giuristocrazia. Per mantenere questa egemonia senza rischiare rivolte dirette, le élite hanno sostituito l’oppressione lineare con una “Tirannia per interposta persona”. Attraverso la metafora del formicaio e casi clinici quotidiani (dalle espulsioni bloccate alle occupazioni abusive), il saggio svela come il macro-sistema utilizzi il singolo patogeno (il criminale, il vandalo) come una vera e propria arma biologica. Schiacciando gli anticorpi sociali tramite le sentenze dei tribunali, l’oligarchia ottiene il suo duplice movente termodinamico: distruggere la coesione del Vettore Orizzontale (Divide et Impera) e generare una dipendenza assoluta del cittadino terrorizzato verso la Macchina Vuota.

Capítulo 25. El Sometimiento Constitucional y la Tiranía por Interpuesta Persona

Abstract: En el capítulo anterior hemos diagnosticado la Autopoiesis de la “Máquina Vacía”: la burocracia baja y media defiende al criminal para garantizarse la supervivencia económica. Sin embargo, si alzamos la mirada hacia la cúspide absoluta de la pirámide, emerge una geometría del dominio mucho más oscura. Este capítulo demuestra cómo la inserción de los “Derechos Humanos” positivos en las Constituciones ha transformado matemáticamente al pueblo de soberano a siervo, entregando el Poder absoluto a una oligarquía intocable: la Juristocracia. Para mantener esta hegemonía sin arriesgarse a revueltas directas, las élites han sustituido la opresión lineal por una “Tiranía por interpuesta persona”. A través de la metáfora del hormiguero y de casos clínicos cotidianos (desde las expulsiones bloqueadas hasta las ocupaciones abusivas), el ensayo revela cómo el macrosistema utiliza al patógeno individual (el criminal, el vándalo) como una verdadera arma biológica. Al aplastar los anticuerpos sociales mediante las sentencias de los tribunales, la oligarquía obtiene su doble móvil termodinámico: destruir la cohesión del Vector Horizontal (Divide et Impera) y generar una dependencia absoluta del ciudadano aterrorizado hacia la Máquina Vacía.

Chapter 25. Constitutional Enslavement and Tyranny by Proxy

Abstract: In the previous chapter, we diagnosed the Autopoiesis of the “Empty Machine”: the lower and middle bureaucracy defends the criminal to guarantee its economic survival. However, if we raise our gaze to the absolute apex of the pyramid, a much darker geometry of dominion emerges. This chapter demonstrates how the insertion of positive “Human Rights” into Constitutions has mathematically transformed the people from sovereign to servant, handing absolute Power to an untouchable oligarchy: the Juristocracy. To maintain this hegemony without risking direct revolts, the elites have replaced linear oppression with a “Tyranny by proxy.” Through the metaphor of the anthill and everyday clinical cases (from blocked deportations to abusive squatting), the essay reveals how the macro-system uses the individual pathogen (the criminal, the vandal) as a literal biological weapon. By crushing social antibodies through court rulings, the oligarchy achieves its dual thermodynamic motive: destroying the cohesion of the Horizontal Vector (Divide et Impera) and generating an absolute dependence of the terrified citizen on the Empty Machine.
