1. From the Market of Chaos to the Apex of the Pyramid
In Chapter 24, we unveiled the Autopoiesis of the system: we understood that the bureaucratic and legal apparatus (NGOs, cooperatives, social workers, lower courts) protects the criminal because the latter is the economic “Asset” that justifies their salaries and their procedural existence. However, if we raise our gaze to the absolute apex of the pyramid—supranational elites, major financial powers, and supreme Constitutional Courts—the purely bureaucratic explanation is no longer sufficient. These apex entities have no interest in the self-preservation of a provincial office. They exploit the machine’s blindness for a much higher and ruthless engineering purpose: absolute geopolitical and social dominion.
To understand who truly dominates the contemporary Western ecosystem, we must abandon the linguistic sophistications of political science and analyze the thermodynamic dichotomy between Power and Duty. In relational physics, Power is the ability to command ample Degrees of Freedom (NDoF) and to impose direction (the garment of the Master). Duty is the topological obligation to yield one’s energy to satisfy a rule imposed from the outside (the garment of the Servant).
To clarify this dichotomy irrefutably, we can resort to a formidable theological paradox. Classical theology defines God as “Omnipotent,” meaning the holder of absolute Power, the creator of the rules to which the universe must obey. But let us try to imagine, per absurdum, an “Omniobligated” God: an entity forced by superior constraints to obligatorily take care of everything and everyone, without being able to evade this task. This God would not be omnipotent at all; he would be the absolute servant of the universe, chained to the needs of his own creatures and stripped of any freedom to maneuver. The law of physics is ruthless: whoever holds Power commands; whoever is burdened by Duty, serves.
2. The Constitutional Trap and the Oligarchy of Judges
The democratic narrative deludes us into thinking that Power belongs to the sovereign people. But with the advent of twentieth-century Republican Constitutions and European Treaties, a devastating genetic mutation occurred. Unlike nineteenth-century charters (which placed negative limits on the sovereign, acting as zero-cost shields), the new fundamental charters introduced an avalanche of “positive” and inalienable Human Rights.
It is here that the most colossal thermodynamic scam of modernity is consummated. Lawmakers made the masses believe that writing a new “Right” into the Constitution was a gift. But the Mechanics of Community reveals the inexorable deception: every positive “Inalienable Right” granted in the abstract to an individual or a foreigner instantly and mathematically translates into an “Inescapable Duty” borne by the host community.
If the people have been reduced to the rank of “servant,” burdened with the asphyxiating duty to economically and socially maintain the Abstract Rights written on paper… who holds the Power today? To understand this, one only needs to observe the clinical reality of internal and foreign policy. As soon as an elected Parliament attempts to pass a law to close borders or severely punish criminality, that law is instantly blocked, quashed, and annulled. The true absolute masters, the undisputed sovereigns of the contemporary West, are the members of an unelected, untouchable, and invisible oligarchy: the Judges of Constitutional Courts and European Courts.
Clinical Example (The Denied Deportation): A foreign citizen commits repeated violent crimes in a European nation. The Parliament (expression of the people) passes a law to deport him and protect the community. But the European Court of Human Rights (ECHR) blocks the deportation, establishing that in his country of origin the criminal would risk “inhuman treatment” or would not have access to the same medical care (the abstract right). At that precise instant, real Power manifests itself: the supranational judge forces the host community to keep the predator, to suffer his future crimes, and to pay for his room and board in prison. The people have become the “Omniobligated” God: servants in their own home, forced to sacrifice themselves for the rights of the pathogen.
Political scientist and jurist Ran Hirschl (2004) codified this phenomenon in his groundbreaking essay Towards Juristocracy, demonstrating that the massive transfer of power from Parliaments to Constitutional Courts is a cynical strategy of hegemonic preservation: elites have armored their political power by handing it over to judges to insulate it from democratic will. The Constitution is a “source code” that mathematically transforms the people from holders of Power to servants of their own Duties, handing command to the judicial oligarchy.
3. The Geometry of Dominion: The Anthill Paradox
But how does this Juristocracy maintain dominion without suffering a violent and bloody revolt from the expropriated people? In the ancient world, the interaction of dominion was linear and direct: the strong State (the monarch or the dictator) directly crushed the weak citizen by sending its secret police. This method, however, makes the tyrant immediately visible. The oppressed people recognize the source of their pain, accumulate Tensorial Heat (ΦHS), and, sooner or later, unite in a revolution to cut off the sovereign’s head.
Contemporary oligarchies have learned the lesson and replaced the straight line with a triangular geometry. The masters of the “Empty Machine” no longer oppress the community directly; they subject the community to individual pathogens. The street predator, the squatter, and the deviant are elevated to masters of the territory by the precise will of the Courts. It is the genesis of Tyranny by proxy.
To understand the atrocity and efficacy of this architecture, we can use an isomorphism drawn from ethology: the anthill paradox. Imagine a colony of ants, a perfect organic ecosystem. One day, a predatory insect (a parasite) penetrates the nest. Instinctively, the colony’s biological algorithm activates: the soldier ants (the white blood cells) rush to kill it and save the colony. At this point, the human observer towering over the anthill intervenes. He does not destroy the entire nest. He does something much more perverse: every time the soldier ants try to bite the parasite, the observer drops his giant boot and crushes only the ants that are defending themselves. At the same time, he erects a protective barrier around the parasite, preventing it from being harmed.
By repeating this operation dozens of times, the anthill’s biology short-circuits. The surviving ants learn that defending themselves leads to certain death at the hands of an invisible, omnipotent “God.” They surrender. The nest is forced to submit to the predator, yield its resources to it, and allow itself to be devoured rather than suffer the wrath of the boot.
This is the exact photograph of Western democracies. The predator is the serial pathogen (the robber, the youth gang, the squatter). The soldier ants are the honest citizens, the fathers of families, or the neighborhood police officers attempting to react physiologically. The observer with the giant boot is the Constitutional Oligarchy.
Clinical Example (The homeowner and the squatter): A citizen buys a house with their life savings, but one day finds it illegally occupied. Their biological instinct (the soldier ant) would order them to break down the door and kick out the intruder. But the Juristocracy drops the boot: the judges establish that the squatter has the “inalienable right to housing” and cannot be evicted. If the owner tries to change the lock or shut off the utilities, they are arrested and prosecuted for “arbitrary exercise of one’s rights” or “coercion.” The boot crushes the antibody.
Exploiting the hallucination of the aggressor’s inalienable rights, Constitutional Courts drop the judicial axe on anyone attempting to activate the immune system. The individual pathogen is thus transformed by the Empty Machine into a literal Viceroy of chaos: an unwitting biological mercenary, armed with impunity by the powers that be to exhaust the population.
4. The Thermodynamic Motive: Divide et Impera
What is the thermodynamic advantage, for the apex of the pyramid, in handing their cities over to pathogens and common criminals? The engineering motive rests on two strategic pillars of dominion:
A. The destruction of cohesive force (The collapse of the Horizontal Vector) If a civic community were free to self-govern, punish its own criminals, and defend its street perimeter, it would create an immensely strong, united, and proud Horizontal Vector. But a cohesive people has the thermodynamic energy and the time to raise its head, analyze macro-economics, contest disadvantageous international treaties, and challenge the oligarchy. How do you prevent a people from looking up and judging the elite? By subduing them from below.
By injecting daily chaos and forbidding reaction, the system pushes the citizen into isolation, depression, and a perpetual state of anxiety. Clinical Example (The Commuter): Consider a commuting worker or a terrified mother worrying about her daughter returning home by train at night. This person exhausts all their Thermodynamic Surplus (their mental and physical energy) in the desperate attempt to guarantee simple daily biological survival. A citizen whose mind is entirely occupied with defending themselves from the pickpocket, the drug dealer, or the squatter will never have a single Joule of vital energy left to organize a union, study global financial flows, or fight the elites operating in the high palaces. It is the perfect Divide et Impera. While the streets of the people burn, the masters of the Empty Machine live isolated in hyper-protected gated communities, totally immune to the chaos their rulings generate.
B. Absolute dependence on the Empty Machine Breeding the pathogen and protecting it generates endemic insecurity. A people immersed in anarchy and disarmed of their own antibodies falls into terror. And a terrified people, despite hating their own executioner, always ends up begging on their knees for its protection. The Empty Machine generates the emergency (the untouchable crime wave) and then proposes itself as the sole and indispensable savior. To “protect” citizens from the monsters it has itself armed with rights, the State will justify the introduction of increasingly oppressive control tools: facial recognition cameras, privacy limitations, exclusively traceable digital transactions, preventive censorship. The desperate citizen, emptied of any other option, will gladly surrender their last remaining Degrees of Freedom (NDoF) in exchange for a shred of security.
Conclusion: The Weapon of Mass Destruction
Tyranny by proxy is the perfect dominion engineering of the twenty-first century.
The global oligarchy and the Juristocracy have no need to send the Gestapo, tanks, or the secret police to crush the freedoms of a Nation. Linear oppression is a relic of the past. Today, it is enough to apply the lethal asymmetry of human rights: providing stainless steel shields to those who assault the social pact, and judicial cleavers to those who attempt to defend it.
Through this topological short-circuit, the criminal ceases to be a statistical anomaly and becomes, to all intents and purposes, the Biological Weapon wielded by the powers that be against local communities. Constitutional Courts, supranational lawmakers, and the judges who protect the aggressor are not the defenders of civilization against barbarism. They are, coldly, the sadistic observers who drop the boot to crush the soldier ants, ensuring that the anthill—bloodless, isolated, and perpetually subjugated to the parasite—never again has the strength to lift its gaze toward the sky.
